Welcome to Flightkart.
These Terms and Conditions explain the rules for using Flightkart and for booking travel services through us. You can use our services online, by telephone, by email, through WhatsApp, or through direct consultation.
Flightkart helps customers find flights, get quotes, and book domestic and international flights. We also arrange other travel services where available.
When you use our website, contact us, request a quote, or make a booking, you agree to these Terms and Conditions. Airlines, accommodation providers, insurers, tour operators, transfer providers, and other Travel Service Providers may also apply their own terms to the services they supply.
1. Definitions
In these Terms:
- “Flightkart”, “we”, “us” or “our” means Vishine Ventures Limited, trading as Flightkart (NZBN: 9429051398675), of 33 Totara Avenue, New Lynn, Auckland 0600, New Zealand.
- “Website” means the Flightkart website (flightkart.co.nz) and any related online services operated by us.
- “You” or “your” means the person using our website, requesting a quote, or booking or arranging a travel service.
- “Booking” means a flight or other travel reservation made or arranged through Flightkart, whether online, by telephone, by email, through WhatsApp, or through direct consultation.
- “Travel Service Provider” means an airline, hotel, car rental company, cruise company, accommodation provider, insurance provider, or another travel company whose services are booked or arranged through Flightkart.
- “Services” means the quotes, bookings, ticketing, travel information and advice, customer support, and other travel services provided or arranged by Flightkart, whether online or offline.
- “Destination Management Company” or “DMC” means a local company that helps arrange travel services in a specific destination, such as accommodation, airport transfers, tours, and other travel needs.
Please read these Terms and Conditions carefully before using our website or making a booking.
2. Using the Flightkart Website
Our website allows customers to search for travel information, compare available flight options and, where available, book domestic and international flights and other travel services. You may also request quotes and arrange bookings with us by telephone, email, WhatsApp, or through direct consultation.
When using our website, you agree that:
- You are legally able to enter into a contract.
- The information you provide is accurate and up to date.
- You will use the website only for legal purposes.
- You will only make bookings for yourself, or for someone you are authorised to book for.
- You will not misuse, damage or interfere with the website or its security.
- You will not use the website or services to make fraudulent or unauthorised bookings.
We may restrict or suspend access to our website or services where we reasonably believe that it is being misused, used fraudulently or used in breach of these Terms or applicable law.
3. Changes to These Terms
We may change these Terms from time to time.
If we make any changes, we will update the Terms on our website and revise the “Last Updated” date. The updated Terms apply to your future use of our website and services and to bookings made after the changes are posted.
Updated Terms will not affect a booking that has already been confirmed, unless the change is required by law or where the booking-specific terms of the relevant Travel Service Provider provide otherwise.
4. Flightkart’s Role
Flightkart provides travel quotes, booking, ticketing, and related customer support services online, by telephone, by email, through WhatsApp, and through direct consultation.
Depending on the service, Flightkart may act as an agent, intermediary, reseller, or booking facilitator between you and the relevant Travel Service Provider. The role that applies to your booking depends on the service, as follows:
- Flights (domestic and international): Flightkart acts as a booking agent and intermediary between you and the airline. We compare options, arrange your booking and ticket, and provide support. The airline operates the flight and is responsible for the air transportation.
- Accommodation: Flightkart arranges bookings as an intermediary with hotels and other accommodation providers. The property or supplier provides the accommodation, and its inclusions, payment terms, and cancellation conditions apply.
- Airport transfers: Flightkart arranges transfers through third-party local transfer companies and destination management companies. We do not operate our own vehicles or employ drivers.
- Escorted group tours and private trips: Flightkart plans and coordinates your trip using airlines, accommodation providers, destination partners, and other suppliers. Each supplier is responsible for the part of the trip it provides.
- Travel insurance: Flightkart helps you compare and understand options from third-party insurers and helps you complete the necessary details. The insurer issues and manages the policy and decides on any claim. Flightkart is not the insurer.
- Visa assistance: Flightkart provides general travel information and itineraries only, as explained in Section 7. We do not provide immigration advice.
The role that applies to your booking will be confirmed in your quote or booking documentation where relevant. Flightkart works with major airlines and travel partners at different destinations. Flight options and prices depend on your route, travel dates, and the airline’s booking rules. We only claim an exclusive partnership with an airline if it is clearly stated in writing.
Flightkart is not a licensed immigration adviser and is not a licensed insurance broker. Our role in visa and travel insurance matters is described in Sections 7 and 20.
When you book an airline ticket through Flightkart, the airline operating your flight remains responsible for operating the flight and providing the air transportation service.
Travel Service Providers may have their own terms, conditions, and rules. These may apply to your booking in addition to these Terms, and may cover matters such as:
- Ticket changes
- Cancellations
- Refunds
- Baggage
- Check-in
- Flight changes
- Travel documents
- Additional services
- Other booking restrictions
Where relevant information is available to us, we will provide it to you.
Nothing in these Terms removes any rights you may have under applicable New Zealand law.
5. Booking and Ticket Issuance
A booking with Flightkart moves through the following stages. Each stage has a different meaning, and only the last one means your ticket has been issued.
- Quote or enquiry: A quote or enquiry does not create a booking and does not hold a fare or a seat.
- Reservation: We may place a reservation with the airline or Travel Service Provider, and you may receive a booking reference. A booking reference alone does not mean your booking is confirmed or that a ticket has been issued.
- Payment: Your booking cannot proceed to confirmation until we have received the payment due, as set out in Section 15.
- Booking confirmation: Your booking is confirmed when we receive your payment and send you written confirmation by email, WhatsApp, or another electronic means.
- Ticket issuance: Your airline ticket is issued when the airline has issued it. Where applicable, we will send you your ticket or itinerary showing the ticket number as soon as reasonably possible after it is issued. Ticketing times depend on the airline, the fare, and how your booking is made, and some bookings take longer than others.
Until your ticket has been issued, fares, taxes, and availability may change, and the airline may cancel an unticketed reservation.
After receiving your booking confirmation and ticket, you should check:
- Passenger names
- Travel dates
- Departure and arrival airports
- Flight times
- Baggage allowance
- Fare conditions
- Booking reference
- Ticket number, where applicable
If you identify an error in any of these details, please contact Flightkart as soon as possible.
6. Passenger Information
You are responsible for providing correct passenger and booking information, whether you give it to us through our website, by telephone, by email, through WhatsApp, or in person.
This includes names, dates of birth, contact details, and any other information required to complete the booking. You must also keep your contact details up to date so that we can reach you about your booking (see Section 11).
Passenger names must be given exactly as they appear in the passenger’s travel document and as required by the relevant airline or Travel Service Provider.
If you provide incorrect information, the airline or Travel Service Provider may refuse a change or charge a fee for correcting it.
7. Passport, Visa and Travel Documents
You are responsible for ensuring you have all documents required for your journey.
Depending on your destination and itinerary, you may need:
- A valid passport
- A visa
- A transit visa
- An entry permit
- Health or vaccination documents
- Other documents required by an airline or government authority
Travel requirements may change and can depend on your nationality, destination, and transit points. Before you travel, check the latest requirements with the relevant embassy, consulate, government authority, or airline.
Visa and entry information provided by Flightkart
Flightkart may assist you by checking publicly available information about whether a visa or entry permission may be required, and by preparing travel itineraries for use in visa applications. Any visa or entry information we provide is general information only. It is not immigration advice, and it does not guarantee that a visa will be approved or that you will be allowed to enter or transit through any country.
Flightkart is not a licensed immigration adviser and is not licensed by the Immigration Advisers Authority (IAA). We do not provide immigration advice, assess visa eligibility, prepare or certify visa applications, interpret immigration law, submit applications on your behalf, or represent you before immigration authorities. If you need immigration advice, please contact a licensed immigration adviser or the relevant government authority.
You are responsible for completing and submitting your own application, paying any applicable fees, providing supporting documents, and ensuring all information you provide is accurate and complete. Visa fees, processing times, and decisions are set by the relevant embassy, consulate, or immigration authority.
Flightkart cannot guarantee admission to or transit through any country. You are responsible for meeting the passport, visa, health, and entry requirements that apply to you.
8. International Travel
International journeys may be subject to international air travel laws, conventions, and other applicable regulations, including the Montreal Convention where applicable.
The rules that apply depend on your journey and the applicable law.
Booking a flight to a particular destination does not mean that Flightkart considers that destination safe or suitable for travel. You are responsible for checking current travel advisories for your destination and transit points before you travel.
Travel risks, travel warnings, and insurance-related matters are addressed separately in our Travel Insurance/Disclaimer information (see also Section 20).
9. Baggage
Each airline has its own baggage rules.
Unless your booking clearly states otherwise, baggage fees and additional baggage services may not be included in the ticket price. Where baggage information is available to us, we will include it in your quote or itinerary.
You are responsible for checking the baggage conditions applicable to your booking, including:
- Baggage allowance
- Maximum baggage weight
- Size restrictions
- Additional baggage charges
- Restricted or prohibited items
If your itinerary involves more than one airline, different baggage rules may apply to different flights. Please also see Section 18 for baggage on separate tickets.
10. Check-In and Airport Arrival
Check-in times vary by airline and airport.
Please check your airline’s check-in requirements before your flight and arrive with enough time to check in, drop baggage, and go through security. If you miss a check-in or boarding deadline, the airline may refuse to carry you, and any change or refund options will depend on the airline’s rules and your fare conditions.
11. Flight Changes, Delays and Cancellations
Airlines can change, delay, or cancel flights for various reasons, such as bad weather, technical problems, operational changes, or other unexpected situations.
Changes to a flight may include:
- A change to the departure or arrival time
- Cancellation of the flight
- A change in the flight number
- A change of aircraft
- A change to the route or connecting flights
The airline is responsible for managing its flight schedule and operating the flight.
Contacting you about changes
If we receive notice of a flight change or cancellation, Flightkart will try to contact you using the details you gave us when you booked. Airlines can make changes at short notice, so you must:
- Check your email, telephone, WhatsApp, and SMS messages regularly, including your spam and junk folders.
- Keep your contact details up to date by telling us as soon as they change.
- Check your flight status with the airline regularly, and again shortly before you travel.
If we cannot reach you because your contact details are incorrect or out of date, or because you did not see or act on a message, we may not be able to help you with the options that would otherwise have been available.
Your options after a change or cancellation
The options available after a flight change or cancellation depend on the airline’s rules, your fare conditions, and applicable law. Depending on the airline, they may include rebooking on another flight, a travel credit, or a refund. The airline decides which options are offered.
Where applicable, Flightkart will assist you with the options available to you. For refunds, see our Refund and Cancellation Policy. For disruptions caused by events outside our control, see Section 36.
Nothing in this section limits any rights you may have under applicable law.
12. Changes and Cancellations Requested by You
If you want to change or cancel your booking, please contact Flightkart as soon as possible. Some fares cannot be changed or cancelled, and deadlines can be short.
Whether a change or cancellation is permitted depends on the applicable fare rules and the terms of the relevant Travel Service Provider.
Fees, fare differences, and other charges may apply, including:
- Change or cancellation fees charged by the airline or other Travel Service Provider
- Fare differences and any difference in taxes or charges
- Flightkart service or agency fees
- Payment or card processing fees, where applicable
For detailed information about refunds, refund eligibility, fees, and processing times, please refer to our Refund and Cancellation Policy. Refund processing times depend on the airline or Travel Service Provider and on your payment provider.
Nothing in these Terms limits any rights you may have under applicable law.
13. Passenger Name Corrections
Please check all passenger names carefully before completing your booking, and make sure they match the passenger’s travel document (see Section 6).
Airlines have different rules for name corrections and changes. Some may permit minor spelling corrections, while others may charge a fee or may not permit changes. Most airlines do not allow a ticket to be transferred to a different person.
If you identify a name error, please contact Flightkart as soon as possible.
Any applicable airline fee, fare difference, Flightkart service fee [if applicable], or restriction will depend on the relevant Travel Service Provider’s rules.
14. Flight Overbooking
Airlines may sometimes sell more tickets than the number of available seats.
If an airline is unable to provide your booked seat because of overbooking, the airline is responsible for deciding and providing any options or compensation. These will depend on the airline’s policies and applicable law.
Flightkart will provide reasonable assistance where possible.
15. Payments and Charges
Your payment may be processed by Flightkart, an airline, another Travel Service Provider, or an authorised payment provider. Depending on how your booking is processed, you may see more than one transaction on your bank or card statement.
Fees
Flightkart may charge service or processing fees where applicable, and these will be disclosed before you complete the relevant transaction (see Section 26). Airlines and other Travel Service Providers may also charge their own fees. Where the information is available to us, your quote or booking summary will show the fare, taxes, and fees that apply to your booking.
Payment methods
We accept payment by Visa, Mastercard, and American Express. We may ask you to verify the cardholder’s identity before we accept a card payment.
Payment deadlines
Payment must be received in full by the deadline stated in your quote or booking confirmation. Payment deadlines, deposits, and balance due dates depend on the airline or Travel Service Provider and on the type of booking, including flights, group bookings, accommodation, and tours. Where a deposit or staged payment applies, the amounts and due dates will be set out in your quote or booking confirmation. Fares and availability are not guaranteed until payment has been received and the ticket has been issued.
Failed or declined payments
If your payment is declined, fails, or cannot be verified, your booking may not proceed. The fare or availability may change, and the airline may cancel an unticketed reservation. If you need to rebook, you may have to pay a higher fare.
Reversed or disputed payments
If a payment is reversed, recalled, or disputed after your booking has been confirmed or ticketed, we may treat the booking as unpaid. You may be required to pay any amount owing, including any fees or charges that result from the reversal, and we may cancel the booking where the airline’s or provider’s rules allow. See Section 37 for payment disputes.
Cancellation for non-payment
If we do not receive payment by the deadline, we may cancel your booking. We will try to tell you before we do, but we may cancel without notice where an airline or provider deadline requires it. Any cancellation fees charged by the airline or provider because of non-payment are your responsibility.
Incorrect charges
If you believe that a payment or charge is incorrect, please contact Flightkart so that we can review the matter.
16. Currency and Bank Charges
Prices are shown in New Zealand dollars (NZD) unless your quote or booking confirmation states otherwise.
If your bank or card account uses another currency, your bank or card provider may apply currency conversion charges, foreign transaction fees, or other charges.
The exchange rate used by your bank or card provider may differ from any rate shown in a Flightkart quote or on our website.
Flightkart does not control fees charged by your bank or card provider.
17. Separate Tickets and Self-Transfer Itineraries
Some itineraries may contain separate tickets or flights that are not connected through an airline’s interline arrangement. Where we are aware that your itinerary includes separate tickets, we will let you know before you confirm your booking.
If you book separate tickets, you may need to:
- Check in separately for each flight
- Collect and re-check your baggage
- Pass through immigration or security
- Meet applicable visa or transit requirements
- Allow sufficient time between flights
If one flight is delayed or cancelled, the airline operating your other flight is not usually responsible for rebooking or refunding you, and you may need to buy a new ticket at your own cost.
You are responsible for checking the conditions of your itinerary and for allowing enough time between separate flights.
18. Baggage on Separate Tickets
When flights are booked on separate tickets, baggage may not be transferred automatically between airlines.
You may need to collect your baggage after one flight and check it in again for your next flight, and additional baggage fees may apply.
You are responsible for complying with the baggage rules of each airline (see also Section 9).
19. Unaccompanied Minors
Airlines have their own rules for children and passengers travelling without an adult. Depending on the airline and the route, these rules may include:
- A ban on unaccompanied minors on certain routes or flights
- Minimum and maximum ages
- Additional fees for an escort or supervision service
- Special booking requirements, such as booking by telephone or through the airline directly
- Required documents, such as consent letters and contact details for the adults at both ends of the journey
Before booking travel for an unaccompanied minor, please tell us the child’s age and check the airline’s current requirements.
Flightkart may be unable to issue a ticket where the airline does not permit the child to travel alone or where the required arrangements cannot be made.
20. Cancellation Protection and Travel Insurance
If Cancellation Protection, travel insurance or another protection product is offered with your booking, it may be subject to separate terms and conditions.
Where the product is provided by a third-party insurance or protection provider, that provider’s terms, conditions, exclusions and claim procedures will apply.
The applicable information will be provided during the booking process or in your booking documentation where available.
For information about travel risks, insurance and related disclaimers, please refer to our Travel Insurance/Disclaimer page.
21. Airlines and Other Travel Service Providers
Your booking may include services provided directly by hotels, car rental companies or other travel providers.
These providers are responsible for their own services and may have separate terms, rules and policies.
Flightkart does not control how these providers operate their services.
If you experience an issue with a Travel Service Provider, Flightkart will provide reasonable assistance where we can.
Nothing in this section removes any rights you may have against Flightkart under applicable law.
22. Accommodation Bookings
Flightkart may assist with accommodation, including hotels, resorts, serviced apartments, homestays, hostels, villas and group or tour accommodation, subject to supplier availability. Accommodation may be arranged as part of a wider trip, and we may also assist with standalone bookings.
Final booking terms, cancellation conditions, inclusions and payment requirements depend on the selected property and supplier, and these will apply to your booking.
23. Airport Transfers
Flightkart does not necessarily operate its own vehicles or employ its own drivers. We arrange airport transfers through third-party local transfer companies and destination management companies, subject to availability.
Transfer options, vehicle types and coverage vary by airport and destination, and availability is confirmed at the time of booking. To help us arrange your transfer correctly, please provide accurate flight details, accommodation information, passenger numbers, luggage requirements and contact details.
24. Group Bookings, Group Rates and Bundled Pricing
Pricing may differ between individual and group bookings. Group rates depend on room numbers, dates, property availability, payment deadlines, rooming requirements, inclusions and supplier terms, and are not guaranteed until confirmed in writing.
Group bookings follow the airline’s or supplier’s rules, which differ from individual bookings. Depending on the provider, these may include:
- A deposit to secure the booking, with the balance due by a set date
- A deadline for providing passenger names
- A minimum number of travellers needed to keep the group rate
- Limits on name changes and on reducing the number of travellers
- Cancellation and refund rules that differ from individual bookings, including non-refundable deposits
The conditions that apply to your group will be set out in your quotation or group booking confirmation.
A bundled discount may be available when you book flights, accommodation and transfers together, depending on the supplier, destination, itinerary and current promotional pricing. Any discount will be confirmed in your quotation and is not a standard offer.
25. Tours and Packages
Flightkart may plan and coordinate escorted group tours, private trips, and packages that combine services such as flights, accommodation, and transfers. Each supplier is responsible for the part of the trip it provides.
Inclusions, payment schedules, and cancellation conditions vary by supplier and will be set out in your quotation or booking documentation. Changing or cancelling one part of a trip may affect other parts, and fees may apply to each part. A package price or discount may no longer apply if part of the package is changed or cancelled.
26. Flightkart Service Fees
Flightkart may charge a service or agency fee in addition to the airline fare, taxes, and any charges set by an airline or another Travel Service Provider. Where a fee applies, it will be shown in your quote or booking summary before you pay.
Depending on the service, a Flightkart fee may apply to:
- Flight bookings and ticketing
- Changes to a booking
- Cancellations and refund processing
- Passenger name corrections
- Urgent or after-hours assistance
- Payment or card processing
Flightkart’s fees are separate from fees charged by airlines and other providers. Whether a Flightkart fee can be refunded will be explained in your quote or in our Refund and Cancellation Policy.
27. Quotes and Enquiries
You can request a quote online, by telephone, by email, via WhatsApp, or through direct consultation. A quote or enquiry does not create a booking and does not hold a fare, a seat, or a price.
Quotes are based on the fares, taxes, and availability at the time we prepare them. A quote stays valid for the stated period, and only as long as the airline or provider continues to offer the same fare. Fares can change or sell out before payment is received and your ticket is issued, even within that period. Please see Section 5 for how a booking moves from reservation to ticket issuance.
28. Special Requests
You can ask for special arrangements such as wheelchair or mobility assistance, special meals, seat preferences, medical needs, or infant requirements. Please mention them when you request a quote or book, and as early as possible before travel, because some requests have deadlines.
Flightkart passes special requests to the airline or Travel Service Provider. They remain subject to the provider’s confirmation, availability, and rules, and some carry extra charges. Flightkart cannot guarantee that a request will be accepted unless the provider confirms it in writing. Please check with the airline before you travel to make sure your request has been noted.
29. Children and Infants
Airlines set their own age definitions, fares, and rules for children and infants. In general, an infant is under 2 years old and a child is aged 2 to 11 on the date of travel, but the definition used by your airline applies. Please give us each child’s or infant’s age on the date of every flight when you request a quote.
Infant fares usually do not include a seat, and baggage allowances for infants are often smaller than for adults. Airlines may limit how many infants can travel with one adult. Bassinets and baby seats vary by aircraft, are limited, and are arranged through the airline.
Every child and infant needs their own valid passport and any required visa or other documents (see Section 7). For children travelling without an adult, please see Section 19.
30. Electronic Communications
Flightkart may send quotes, booking confirmations, tickets, itineraries, payment requests, and notices about changes to your booking by email, WhatsApp, SMS, or other electronic means, using the contact details you gave us. By giving us those details, you agree to receive these messages electronically.
Please check your email, WhatsApp, and SMS messages regularly, including your spam and junk folders, and keep your contact details up to date. Where the law requires a different form of notice, we will follow it. Please also see Section 11.
31. After-Hours Assistance
Flightkart’s customer support team is available during the hours shown on our website. Outside those hours, you can leave a message by email or WhatsApp, and we will reply when we reopen.
If we can help urgently outside normal hours, such as with emergency rebooking, a fee may apply. We will tell you about any fee before we start. For problems on the day of travel, please also contact the airline directly.
32. Privacy and Personal Information
We collect, use, store, and share personal information in line with our Privacy Policy and New Zealand privacy law. We may share the information needed for your booking with airlines, Travel Service Providers, payment providers, and other authorised service providers, including some based overseas, where necessary to provide our Services, process your booking, or meet our legal obligations.
Our Privacy Policy explains what we collect, how we store and protect it, when we disclose it overseas, how you can access and correct your information, how we use it for marketing, and how we handle data breaches. Please refer to our Privacy Policy.
33. Website Information and Availability
We make reasonable efforts to keep the information on our website accurate and up to date.
However, flight schedules, fares, availability and travel requirements can change.
We do not guarantee that all information displayed on the website will always be complete, current or free from errors.
Our website may also be temporarily unavailable because of maintenance, technical problems or circumstances outside our reasonable control.
If we become aware of an error that affects your booking, we will take reasonable steps to address it.
34. Website Use and Intellectual Property
Unless otherwise stated, the content and materials available on the Flightkart Website are owned by or licensed to Flightkart.
You may use the website and its content for your personal, non-commercial travel-planning and booking purposes.
You must not reproduce, copy, modify, distribute, sell or commercially exploit Website content without our prior written permission, except where permitted by law.
35. Liability
Flightkart will provide its Services with reasonable care and skill. Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other New Zealand law that cannot be excluded or limited.
Subject to that, and to the extent the law allows:
- Airlines and other Travel Service Providers are responsible for the services they provide, including flight operations, delays, cancellations, baggage, accommodation, and transfers. Flightkart is not liable for their acts or omissions, except where we failed to take reasonable care in arranging your booking.
- Flightkart is not liable for loss or damage caused by events outside our reasonable control (see Section 36), or by incorrect information you gave us.
- Flightkart is not liable for indirect or consequential loss, such as lost income, missed events, or non-refundable trip costs.
36. Events Outside Our Control
Some events outside our reasonable control may affect your booking or our services, including:
- Bad weather
- Natural disasters
- Government restrictions or border closures
- Airport closures
- Strikes or industrial action
- War or civil unrest
- Technical problems, including internet or phone outages
- Other unexpected events
If an event like this affects your booking, the airline or Travel Service Provider decides which options are offered. Depending on the provider and your fare, these may include rebooking, a travel credit, or a refund.
Flightkart will contact you where we can, explain the options we have been told about, and help you request them. We cannot guarantee that a particular option will be offered, and provider fees may apply. Please also see Section 35. Nothing in this section limits your rights under New Zealand law.
37. Chargebacks and Payment Disputes
If you have a concern about a payment or card charge, please contact Flightkart first so that we can investigate the issue.
You retain any rights available to you to dispute a transaction with your bank or card provider.
Where reasonably necessary and permitted by law, Flightkart may provide relevant booking, payment and communication information to a payment provider or other authorised party when responding to a payment dispute or chargeback.
38. Complaints and Customer Support
If you have a question, complaint, or concern about your booking or our Services, please contact Flightkart’s customer support team using the details in Section 42. Please include your booking reference and details of the problem.
We will acknowledge your complaint promptly and aim to resolve it as quickly as reasonably possible. If we need more time, we will tell you why and keep you updated.
If you are not happy with our response, you can ask for it to be reviewed by a senior member of our team. If we still cannot resolve it, you may have other complaint or dispute-resolution options under New Zealand law, and you can raise a payment dispute with your bank or card provider (see Section 37).
39. New Zealand Law
These Terms are governed by the laws of New Zealand, unless another law is required to apply.
Any dispute will be dealt with according to applicable New Zealand law and any mandatory rights or dispute-resolution processes available to you.
40. If Part of These Terms Is Invalid
If a court or other authorised body decides that part of these Terms is invalid or cannot be enforced, the remaining provisions will continue to apply.
Where legally possible, the affected provision will be changed only as much as necessary to make it valid and enforceable.
41. These Terms and Your Booking
These Terms, your booking conditions, the applicable Travel Service Provider’s terms and our other applicable policies together set out the terms that apply to your use of our Website and Services.
If a specific booking condition conflicts with these Terms, the specific booking condition will apply to that booking, unless applicable law requires otherwise.
If any part of these Terms conflicts with a mandatory legal requirement, the legal requirement will apply.
